Kyrylo Shevchenko uses mayor of Kyiv "in dark"

The notorious raider Kyrylo Shevchenko, who, according to media reports, left for Montenegro at the beginning of the year, still continues to illegally control the land plots and the company B.M.K.-Building LLC, which he illegally seized in 2020 using forged documents.

B.M.K.-Building LLC, a Ukrainian company established to implement the River Side project on the banks of the Desna River in the territory of the Tkhoniv village council of the Vyshgorod district of Kyiv region with the involvement of foreign investors from Switzerland.

Shevchenko illegally seized the funds of Swiss investors in the River Side project and the assets of B.M.K.-Building LLC.

This was reported by Volodymyr Mikulenko, former vice president of the Kyiv City Boxing Federation, vice president of the NGO INTEGRUM and member of the board of the NGO Protection and Assistance. According to Mikulenko, in 2019, Shevchenko, together with Rostyslav Hrekul, created an organized criminal group aimed at seizing the River Side project - all the assets and companies of B.M.K.-Building LLC, which at that time belonged to a group of investors from Switzerland and Mikulenko himself.

"First of all, I would like to note that the prerequisite for this seizure was another scam that Shevchenko implemented together with a foreign citizen, Maor Hemmo. For several years, they received money from the Swiss company G.L.U. LIMITED company's bank accounts, money from Swiss investors, such as Marc Rich Real Estate, and others to allegedly finance the River Side project and misappropriated it. In total, they misappropriated funds worth about $40 million," the entrepreneur says.

As is known from the media, Kyrylo Shevchenko often hides behind the name of Kyiv Mayor Vitali Klitschko, with whom he allegedly maintains friendly relations. In particular, information was previously published about Shevchenko's cover-up of illegal trade in the city's underpasses and the raider seizure of the Ukrainian Boxing Federation.

However, Volodymyr Mikulenko, despite the complaints he has received from foreign investors about Shevchenko, including intimidation of their representative in Kyiv, is confident that these rumors are most likely spread by Shevchenko himself to give his personality weight and authority, and thus discredit the Kyiv mayor.

"Let's just say that I have made and am making efforts to convince foreign investors that Vitali Klitschko is in no way involved in the criminal offenses committed by Shevchenko Kyrylo together with Grekul Rostyslav. I am convinced that Vitali Klitschko is not aware of this whole story with the raider seizure of land, electric power and the management of B.M.K.-Building LLC, River Holding LLC and PROZRINNIA LLC and has nothing to do with the concealment of established criminal offenses committed by Shevchenko by the law enforcement agencies of Ukraine. I am sure that Shevchenko manipulates the minds of the people he deceived, referring to his close ties with the mayor of Kyiv, to create psychological pressure on the victims," Mikulenko assures.

Journalists from their anonymous sources received a recording of a conversation between Mikulenko and a representative of Swiss investors. When asked, Mikulenko confirmed the authenticity of the recording: "Yes, indeed, this is a recording of my conversation with a representative of Mark Ritchie's family, who invested in the River Side project and were deceived by Shevchenko," Mikulenko said. The recording makes it quite clear that Rostyslav Hrekul is not their authorized representative and in no way represents the interests of the investors. In addition, the representative of the Swiss confirmed that he had received repeated threats of physical violence from Kyrylo Shevchenko.

"This is a gangster group, they are not afraid of the mayor or anyone else. Kyrylo (Shevchenko - ed.) told everyone that he could kill, stab, and so on," the investor's representative said.

In his opinion, many investors are now afraid to allocate funds, in particular, for the reconstruction of Ukraine after the war, as mafia structures like the group of Kirill Shevchenko continue to operate in our country. According to the representative of the Swiss company, this, combined with corruption, is the factor that hinders Ukraine's accession to the European Union the most.

At the same time, the group of Swiss companies investing in the River Side project expresses hope that given the position of Kyiv Mayor Vitali Klitschko, who they believe is interested in a fair resolution of the issue, as well as the work of law enforcement and the judicial system, the stolen money and property will be returned to their rightful owners.

This is how River Side was supposed to look like according to the project, for which Swiss investors allocated $40 million back in 2012.

If we return to the details of the land grabbing scheme itself, Volodymyr Mikulenko notes that in 2019, Kyrylo Shevchenko, together with his accomplices Rostyslav Hrekul, Dmytro Karauchenko, Vitaliy Kulyk and others, developed a scheme to illegally seize property, namely companies, land, money and even electricity facilities belonging to the River Side project.

According to Mikulenko, Kyrylo Shevchenko's group implemented this scheme in several stages.

Initially, in January 2020, Shevchenko, through his accomplice Vitaliy Kulyk, on behalf of the director of River Garden LLC, took actions to raider seize the right to 2.5 mW of electricity capacity owned by B.M.K.-Building LLC. For this purpose, Kulyk used detailed extracts from the state register and documents with a forged signature of Volodymyr Mikulenko, the historical director of B.M.K.-Building LLC, with the subsequent illegal registration of the right to this capacity for River Garden LLC.

Next, Kyrylo Shevchenko, together with Rostyslav Herkul, appropriated land plots on the banks of the Desna River near the village of Oseshchyna, where the cottage community was to be built. In particular, in November 2020, Shevchenko K.V., Kulyk V.O., Smertenko S.Y., together with other members of the OCG, using forged documents of the KMNO notary Kaplun Y.V., illegally seized the corporate rights of Prozriennya LLC. At the same time, Shevchenko, with the participation of other persons, embezzled a land plot of 1.9627 hectares belonging to Vyshgorod Invest Plus LLC, using his official position, without the consent of the company's member Mikulenko V.O., as a result of which Shevchenko received more than USD 1.5 million in cash, and caused losses in especially large amounts to the company Vyshgorod Invest Plus LLC and its member Mikulenko V.O.

In December of the same year, Shevchenko and Grekul (through a close relative and other related persons), through the use of forged documents, illegally and free of charge acquired ownership of land plots with a total area of 36.05 hectares owned by legal entities B.M.K.-Building LLC and Prozriynya LLC, after which, together with the notary of the KMNO Ignatov D.V, using a power of attorney from the non-existent (liquidated) Cyprus company CONOFIX LIMITED, which was forged in terms of its validity and did not grant any powers, committed a raider seizure of the management of River Holding LLC and B.M.K.-Building LLC.

In February 2021, Kyrylo Shevchenko and Vitalii Kulyk seized the management of River Park LLC with the replacement of the legal address with the address of River Garden LLC and First Construction Investment Company LLC, the owners of which are listed as R.V. Grekul and D.G. Karauchenko. Vitalii Kulyk was appointed as the head of River Park LLC without the consent of V.O. Mikulenko, who owns a 49.25% stake in River Park LLC. As a result of such actions, Grekul, Kulyk and Shevchenko seized and established control over forest land plots with a total area of more than 9 hectares, which are adjacent to the land plots of B.M.K.-Building LLC and Prozriynya LLC, located in the coastal protection zone of the Desna River, seized by these persons in December 2020.

In April 2021, Shevchenko, with the participation of Kulyk, filed for self-liquidation with River Holding LLC and B.M.K.-Building LLC. And in December of the same year, they artificially create accounts payable of B.M.K.-Building LLC to lawyer Koval Victoria Borysivna in the amount of UAH 500 thousand, on the basis of which the procedure of de facto fictitious bankruptcy of B.M.K.-Building LLC was initiated.

At the same time, Shevchenko launched an advertising campaign to sell the seized land. He renamed the project River Garden. On the website https://rivergarden.com.ua, you can still buy the actual stolen land, which is currently under arrest as part of the investigation under criminal proceedings №12020100100007369.

Interestingly, the original video of the River Side project was posted on YouTube at https://www.youtube.com/watch?v=oJs5RR5bvvs back in 2014. Instead, after the raider seizure, Kyrylo Shevchenko's OCG created a revised video, changing the name of the project to "River Garden," and posted it at https://www.youtube.com/watch?v=Pd3m3FrEXQA.

In addition, Kyrylo Shevchenko carried out illegal construction, including fencing of the raided land plots, including within the coastal protection zone of 6.1179 hectares (cadastral number 3221888800:38:140:0920) and 3.189 hectares (cadastral number 3221888800:38:140:0921).

For his efforts to restore justice and return the money to the Swiss investors he represents, Volodymyr Mikulenko himself became a defendant in a criminal case for alleged misappropriation of property.

"The impudence of Kyrylo Shevchenko himself is striking, who, together with R.V. Grekul, illegally seized land plots with a total area of 36.5015 hectares and, at the request of Kyrylo Shevchenko himself, initiated a custom-made criminal case against me, in which Kyrylo Shevchenko is considered a victim, in which I am accused of allegedly embezzling land plots of 36.5015 hectares, which are actually owned by Shevchenko and Grekul. Shevchenko K.V., who illegally and free of charge acquired ownership of the land plot with cadastral number 3221888800:38:140:1113 with an area of 7.5088 hectares, accuses me of embezzlement," Mikulenko said.

Based on the information provided by Volodymyr Mikulenko, as well as open sources, the following facts can be established in this case:

-    River Garden LLC has never acquired ownership of the land plots specified in the Supplemental Agreement belonging to B.M.K.-Building LLC;

-    After checking open sources (registers of the Ministry of Justice, NACP website in the "declarations" section), the information contained in the extracts submitted by River Garden LLC was found to be clearly false.

Using the example of the extract submitted for the land plot with the cadastral number 3221888800:38:140:0567 (on which the ZTP No. 1504 is located), it can be established that the record number refers to a different real right - 34448134 in the register of real rights to real estate contains information about the right to lease a completely different land plot located in the territory of Zaporizhzhia region, Tokmak district, and other data of the tenant - BRAT Farm, EDRPOU code 31260833;

In addition, the registration number of the application under which the said extract was generated is the number of another person's application for another object. The real estate registers also do not contain any information on the search criterion "Registration number of the real estate object: 1968459611365"; in fact, it is just a set of random numbers.

According to the open data on the NACP website, the state registrar, Tetyana Bartko, worked as a state registrar not at the PRIORITY, but at the Pershotravensk Village Council of the Obukhiv District of Kyiv Region, which means that she was not actually authorized to carry out registration actions.

The information certificate from the Register of Real Property Rights on all registration actions carried out in relation to the said land plots shows that the lease right to which B.M.K.-Building LLC and River Garden LLC were parties was never registered.

Volodymyr Mikulenko, as the director of B.M.K.-Building LLC, never signed the said Supplemental Agreement, his signature was forged, as evidenced by the Expert Opinion based on the results of the forensic handwriting examination drawn up by Kyiv Scientific Research Institute of Forensic Expertise dated 29.07.2021, number 20728/20729/21-32. Mikulenko did not know and had never met V.O. Kulyk, who signed the said Supplemental Agreement, deliberately used Mikulenko's forged signature and deliberately misled PrJSC Kyivoblenergo about the acquisition of ownership of the land plots of B.M.K.-Building LLC by River Garden LLC.

According to open registration data, the owners of River Garden LLC are citizens of Ukraine Rostyslav Grekul and Dmytro Karauchenko, who not only illegally seized the electric power of B.M.K. Building LLC, but also later, together with Kyrylo Shevchenko and other individuals, members of the criminal group, acquired free ownership of 36 hectares of land previously owned by B.M.K.-Building LLC and sold to PROZRINNIA LLC on legal grounds.

It is known from Internet sources that River Garden LLC offers for sale land plots that do not belong to it and are under arrest under the decision of the Commercial Court in case 908/1487/21 (908/1624/21) of 08.06.2021, the ownership of which was illegally acquired by Kyrylo Shevchenko, Karauchenko, and Grekul's relatives.

Based on these facts, Volodymyr Mikulenko filed a petition with the Commercial Court of Dnipropetrovs'k Region to initiate bankruptcy proceedings. He filed the application with the court to prevent the unlawful liquidation of B.M.K.-Building LLC by K.V. Shevchenko, and to legally restore the rights of individuals and legal entities in relation to B.M.K.-Building LLC.

In the end, this whole story of Swiss investors being robbed only worsens the image of Ukraine as a country open for investment. The figure of Shevchenko and the scandals associated with him also do not help our country in the international arena. After all, Kyrylo Shevchenko is known not only for his land raiding, but also for many other misdeeds, and he tries to hide behind the name of Kyiv Mayor Vitali Klitschko, whom he discredits. At the beginning of the year, Shevchenko, despite all the prohibitions of martial law, traveled across the state border of Ukraine to Montenegro.
